Agreement regarding the Record Attempt
Until we receive a signed copy of this Agreement, your attempt will not be recognised by the WSSR Council.
- You acknowledge that this record attempt may be dangerous to you and others and you agree that you will be entirely responsible at all stages of the record attempt for:
a. Deciding when to commence and whether to proceed with the attempt.
b. All safety aspects in relation to the preparation and undertaking of the attempt.
c. Any injury to yourself or others which is caused by the record attempt.
d. Undertaking to ensure that your vessel complies with the appropriate safety standards laid down by International Maritime Law and by your country of origin or registration.
- Except where arising out of its own negligence, the WSSR Council shall have no responsibility for the safety of any part of the record attempt and on behalf of yourself, your heirs, executors, administrators and assigns, you hereby irrevocably and unconditionally release the WSSR Council, its agents, officers, directors, employees, and subsidiaries from any and all claims for any loss, damage or injury to yourself or your property in connection with the record attempt. You also agree to indemnify the WSSR Council against claims by third parties for injuries arising out of your record attempt.
- This agreement and all matters arising out of your record attempt shall be governed and construed in accordance with English Law and subject to the exclusive jurisdiction of the English Courts, and you waive any and all objections you might otherwise have to venue, or to the personal jurisdiction of the English Courts.
I have read and understand all of the foregoing terms and conditions and agree to be bound by them in exchange for the opportunity to achieve a record or performance.
